1. AGREEMENT TO TERMS
By purchasing a subscription from Ten Directions (“Company,” “We,” “Us”), you (“Subscriber,” “Customer”) agree to be bound by this Subscription Agreement (“Agreement”), along with our Terms of Service and Privacy Policy, incorporated herein by reference.
2. SUBSCRIPTION STRUCTURE
- This subscription consists of three (3) recurring payments, billed on a monthly basis from the initial purchase date.
- The first payment is charged at checkout. Subsequent payments will be automatically charged to the payment method on file.
- The subscription will automatically terminate after the third and final payment is successfully processed.
3. PAYMENT AUTHORIZATION & FAILED PAYMENTS
- Authorization: By purchasing this subscription, you authorize Ten Directions to charge your payment method for the agreed amounts.
- Failed Payment Handling: If a payment fails, the system will automatically retry up to 3 times over 4 days. If all retries fail:
- Your access to the product/service may be suspended or revoked.
- You will be notified and must update your payment details within 3 days.
- If payment remains unsuccessful, the remaining balance will be due immediately and may be sent to a collections agency.
- Chargebacks: If a chargeback is initiated, your subscription will be immediately terminated, and you will be responsible for any chargeback fees incurred by Ten Directions.
4. CANCELLATION POLICY
- Early Cancellation Not Permitted: You agree to complete all three (3) payments as part of this subscription.
- Exceptional Cancellations: If you wish to cancel before completing the payment plan, you must submit a written request to [email protected]. Approval is at our sole discretion, and any unpaid balance may still be due immediately.
- Reinstatement Fees: If your subscription is canceled due to a failed payment, we may charge a reinstatement fee of $25 should you wish to restart.
5. REFUND POLICY
- No Refunds: All payments are final and non-refundable, except where required by law.
- If you experience an issue with the subscription product/service, you must notify us within 5 days of the charge for possible resolution.
6. ACCESS TO SERVICES & TERMINATION
- Access Revocation: If a payment fails or a chargeback is initiated, we reserve the right to immediately revoke access to any products, memberships, or digital content associated with the subscription.
- Legal Action for Non-Payment: If payments are not received after 30 days of default, we reserve the right to pursue legal action or forward the balance to a third-party collection agency.
7. CUSTOMER RESPONSIBILITIES
- You must provide accurate payment details and keep them updated to avoid interruptions.
- You are responsible for ensuring sufficient funds are available for scheduled payments.
8. DISPUTE RESOLUTION
- Any disputes arising under this Agreement shall first be attempted to be resolved through written communication with Ten Directions.
- If a resolution is not reached, disputes shall be handled via binding arbitration in Nova Scotia, Canada.
9. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of [Your Jurisdiction].
10. AGREEMENT ACCEPTANCE
By completing your purchase, you acknowledge that you have read, understood, and agreed to this Subscription Agreement, including the payment terms, cancellation policy, and dispute resolution process.
